Terms of Service

Important notice — read before use

Xcrude is a data analytics and market information technology platform. It is not a broker, not an investment adviser, not a portfolio manager, and not a financial institution of any kind. Nothing on this platform constitutes investment advice, a recommendation, or a solicitation to buy or sell any financial instrument. All outputs are analytical observations about historical and current data patterns — not predictions, guarantees, or personalized recommendations of any kind.

These Terms constitute a legally binding agreement between you ("User," "you") and NextGen Trader Group LTD ("Xcrude," "we," "us," "our").

1.1 Acceptance of Terms

By accessing or using the Xcrude website, dashboard, application, or any related service (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not access or use the Service.

1.2 Description of Service

Xcrude is a subscription-based data analytics platform that aggregates and displays publicly available and licensed third-party data related to crude oil markets, including but not limited to: vessel position and shipping congestion data, government energy inventory statistics, drilling activity data, futures market positioning reports, and calculated price relationships between commodities and currency pairs.

The Service is provided for informational and educational purposes only. Xcrude does not execute trades, hold client funds, manage investments, or provide brokerage services of any kind.

1.3 Eligibility

  • You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is higher) to use the Service.
  • You must provide accurate and complete registration information and keep it up to date.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
  • The Service is not directed at, and may not be used by, residents of jurisdictions where its use would be contrary to local law or regulation. It is your responsibility to determine whether your use of the Service is lawful in your jurisdiction.

1.4 Subscription, Billing, and Payment

Access to the Service is provided on a paid subscription basis. Subscription fees, billing frequency, and included features are described on the pricing page at the time of purchase. By subscribing, you authorize us (and our payment processor) to charge your chosen payment method on a recurring basis until you cancel.

  • All fees are quoted and charged in US Dollars (USD) unless otherwise stated.
  • Subscriptions renew automatically at the end of each billing period unless cancelled prior to the renewal date.
  • We reserve the right to change subscription pricing with at least 30 days' notice to existing subscribers; changes apply from the next billing cycle.
  • Failure to pay may result in immediate suspension or termination of access without further notice.

1.5 No Investment Advice

Nothing provided through the Service — including but not limited to price data, congestion analytics, storage trends, positioning data, generated text summaries, or any “bias” indicator — constitutes financial, investment, legal, or tax advice, nor a recommendation or solicitation to enter into any transaction. Xcrude is not registered as an investment adviser, broker-dealer, or commodity trading advisor in any jurisdiction, and nothing in the Service should be construed as such registration or activity.

1.6 Intellectual Property

All content, design, software, trademarks, and compiled data presentations on the Service are the property of NextGen Trader Group LTD or its licensors and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use only.

  • You may not reproduce, redistribute, resell, scrape, or create derivative works from the Service's content or underlying data without prior written consent.
  • Underlying third-party data (e.g., government statistics, vessel tracking data) remains subject to the terms of the original data provider where applicable.

1.7 Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice, including for suspected violation of these Terms, fraudulent activity, chargebacks, or abuse of the Service. You may cancel your subscription at any time through your account settings; cancellation takes effect at the end of the current billing period unless otherwise required by applicable law.

1.8 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TIMELINESS, OR NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that any data displayed is complete or accurate at all times, given our reliance on third-party data sources outside our control.

1.9 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEXTGEN TRADER GROUP LTD, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, TRADING LOSSES, OR LOSS OF DATA, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

1.10 Indemnification

You agree to indemnify and hold harmless NextGen Trader Group LTD and its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party, including any trading or investment decision you make based on information obtained through the Service.

1.11 Governing Law and Dispute Resolution

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles. Any dispute arising from these Terms or the Service shall first be attempted to be resolved informally; if unresolved, disputes shall be submitted to binding arbitration in London, England and Wales, except where prohibited by applicable consumer protection law.

1.12 Changes to These Terms

We may update these Terms from time to time. Material changes will be notified via email or an in-app notice at least 15 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
